On January 8, 2021, Immigration, Refugees and Citizenship Canada (IRCC) introduced a new temporary policy that allows Post-Graduate Work Permit (PGWP) holders whose work permit has expired or is about to expire to apply for a new open work permit.
This new policy is to facilitate those who should have benefited from their PGWPs but were unable to find job opportunities in Canada due to the impact of COVID-19 on the labour market.
The new open work permit will be 18 months in length.
To be eligible for this new open work permit, you must meet the following requirements:
- Your PGWP must have expired on or after January 2020, or from the date of your application, your PGWP is about to expire in 4 months,
- You must be still in Canada, AND
- You have valid immigration status or have applied for restoration of your status.
IRCC will start accepting applications from January 27 until July 27, 2021. The detailed application process will follow on January 27, 2020.
Being in Canada as an eligibility requirement
Please note that you must be in Canada to be eligible for the new open work permit. If you are currently outside Canada and wish to return, please consult the Government of Canada for travel restrictions.
Under current restrictions, foreign workers (work permit holders) may enter Canada if the travel is considered non-discretionary. Non-discretionary travel means you have a valid work permit and normally live in Canada. It is also important to determine whether you need a temporary resident visa to enter Canada.
If your PGWP has expired while you were outside Canada, you are unable to return to Canada as a foreign worker. However, you may come to Canada as a visitor if your travel is considered essential and meet other currently implemented requirements.
