Yes, you are covered by the ESA even you are not a Canadian citizen or permanent resident. In addition, you are also protected by the Employment Protection for Foreign Nationals Act, 2009 (EPFNA).
The EPFNA protects you by prohibiting employers, recruiters, and representatives of employers from:
- Charging you any fees,
- Taking any property including documents and ID from you,
- Penalizing you because you have claimed your rights under the EPFNA, or
- Asking you to give up any of your legal rights.
