If you have decided or already have filed a claim with the Ministry of Labour, an Employment Standards Officer (ESO) will then be assigned to your claim and decide if your claim shall be allowed. The ESO may conduct telephone interviews, requesting evidence, and other activities that will facilitate in processing your claim.
When you have established your claim, the ESO will issue an enforceable and binding order to you and the opposite party.
You may either enforce the order if the opposite party does not honour it or appeal to the Ontario Labour Relations Board (OLRB) if you do not agree with the order of the ESO.
