What is an Immigration Opinion Letter?
An Opinion Letter is a formal letter drafted by a legal professional explaining the future scenarios about your immigration status. The letter outlines your legal rights and/or responsibilities pertaining to your specific situation by applying to the immigration law.
Often, people use this letter in their immigration process, or sometimes, in civil or criminal proceedings.
The primary purpose of the Opinion Letter is to explain the potential risks of losing your immigration status. It can also provide solutions to maintain your status if there are any. In other cases, the Opinion Letter could just serve as an explanatory evidence for a civil or criminal proceeding.
Scenarios when you should get an Opinion Letter
The scenario where an Opinion Letter is commonly used is when you are charged with an offence in Canada.
In this case, the Opinion Letter explains the impacts the charge may have on your immigration status and provides solutions, if any, to avoid negative immigration consequences. Knowing the impacts and solutions will allow you to take precautionary measures in advance. Sometimes, this letter may also help your criminal lawyer negotiate with the prosecutor.
In all other cases where your immigration status is at issue, the Immigration Opinion Letter will be able to provide the necessary information as you need.
Please note that if you are already found inadmissible, such as criminality or medical issues, there are specific procedures to address these issues. Where it may still be beneficial to get an Opinion Letter, you will have to take more actions in order to follow the procedures.
Can I ask to add or remove certain contents from the Opinion Letter?
An Immigration Opinion Letter should serve well for your needs especially when you intend to use it in other legal proceedings. Therefore, we accept reasonable requests for changes in the Letter we present you.
