If eligible, foreign nationals may work in Canada without a work permit. They can visit Canada for business as a business visitor.
What is a business visitor?
A business visitor is someone who comes to Canada for an international business activity. They only stay in Canada for a short period of time, usually less than 6 months. Although they may not get paid in Canada, they often would need to perform some business-related activities. Hence, they must qualify as a business visitor.
As a business visitor, you can work in Canada without a work permit, and hence, you do not need an LMIA.
Types of business visitor
The following activities may qualify you as a business visitor:
Highly skilled workers and researchers for a short employment under Global Skills Strategy (GSS),
Attendance at business meetings including board of directors’ meetings, trade conventions, or exhibitions (not selling to the public),
After-sales service as part of a warranty or sales agreement,
Supervising or training of installation activities,
Commercial or advertising shoots,
Business visitors under the Free Trade Agreements (FTA).
How to be eligible for a business visitor?
Generally speaking, to be eligible for a business visitor, you cannot enter the Canadian labour market. This means your activity is not going to compete with the same activity of which Canadian citizens or PRs may have had an opportunity to do. Further, the activity you will be doing is international in scope.
There will be more requirements, such as the required documents, depending on the type of business visitor you are applying for.
We can help you determine if you are eligible for business visitor.
How to apply for business visitor?
Note that there is no specific business visitor visa. The process of obtaining a business visitor status depends on whether you need a visa to travel to Canada.
If you can travel to Canada without a visa, you can apply at the Canadian border and demonstrate that you are a business visitor. If you need a visa to enter Canada, you must show the purpose of your visit is for business in your visitor visa application.
When you are travelling to Canada, you also need to show proof of the business activity you will be doing.
